Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the DataWise analytics platform (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind it.
1. Accounts
You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. Notify us promptly of any unauthorized use. New self-service accounts are provisioned with the lowest privilege level; elevated roles are granted only through an administrator.
2. Acceptable use
You agree not to: (a) upload data you do not have the right to use; (b) attempt to access other tenants’ data or circumvent access controls; (c) probe, scan, or disrupt the Service or its infrastructure; (d) use the Service to store or process unlawful content; or (e) reverse engineer or resell the Service except as permitted by law.
3. Your data and content
You retain all rights to the data you upload and the dashboards you create (“Your Content”). You grant us a limited license to host, process, and display Your Content solely to operate the Service for you and those you share with. We do not claim ownership of Your Content and do not use it to train shared models.
4. AI-generated output
Some features use large-language models to generate summaries, suggestions, and narratives. AI output may be inaccurate or incomplete and is provided for convenience — you are responsible for reviewing it before relying on it for decisions. The Service degrades gracefully (with template or cached results) when AI is unavailable.
5. Plans, billing, and changes
Paid plans, if offered, are billed as described at sign-up. We may modify features or these Terms; material changes will be communicated via the “Last updated” date and, where appropriate, an in-app notice. Continued use after changes take effect constitutes acceptance.
6. Intellectual property
The Service, including its software, design, and trademarks, is owned by us and our licensors and is protected by law. These Terms grant you no rights to our marks or software except the right to use the Service as intended.
7. Third-party sources
When you connect a third-party data source, your use of that source remains subject to its own terms. We are not responsible for third-party services or their availability.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that analyses will be accurate.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to your use of the Service. Our aggregate liability will not exceed the amounts you paid us in the twelve months preceding the claim.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access for violations of these Terms or to comply with law. On termination, your right to use the Service ends and we will delete or return Your Content in accordance with our Privacy Policy.
11. Governing law
These Terms are governed by the laws of [your jurisdiction], without regard to conflict-of-laws rules. Disputes will be resolved in the courts located there, unless otherwise required by applicable law.
